Understanding Land Titles in Kenya: Freehold vs Leasehold

Before any purchase in Kenya, understanding the title is essential. It determines exactly what you own and for how long – and it is the single most important document in the transaction.

Freehold vs leasehold

A freehold title grants ownership of the land indefinitely. A leasehold grants use for a fixed term – commonly 99 years – after which it must be renewed. Both are valid; what matters is that the title is clean and the terms are clear.

Do your due diligence

Always conduct an official search at the lands registry, confirm the seller is the registered owner, and check for any caveats or charges. A qualified advocate should guide you through the transfer.
